Terms and Conditions

Effective: May 2026 | In accordance with the Slovenian Consumer Protection Act (ZVPot-1, Official Gazette of the RS no. 130/22), the Electronic Commerce Market Act (ZEPT), the Obligations Code (OZ) and Directive 2011/83/EU.

1. General and seller identification

The online store dglow.si is operated by:

dglow.si is a registered online store selling Korean cosmetics (K-beauty), intended for sale to consumers in Slovenia and other European Union countries.

These Terms and Conditions (hereinafter "Terms" or "T&C") are drawn up in accordance with Slovenian law and govern the legal relationship between the seller (Lun Maligator d.o.o., hereinafter "dglow.si" or "the seller") and the customer.

2. Definitions

• Customer: a person who makes a purchase or places an order through the dglow.si online store.
• Consumer: a natural person who buys products for private use and not for the purposes of their professional, gainful or other economic activity (point 5 of Article 2 of ZVPot-1).
• Seller: Lun Maligator d.o.o.
• Service: all functionality of the dglow.si online store, including browsing, placing an order, creating an account and receiving communications.
• Contract: the sales contract concluded between the customer and the seller at a distance in accordance with Article 130 of ZVPot-1.

3. Acceptance of the Terms

By using the dglow.si online store and placing an order, the customer confirms that they have read, understood and agree to these Terms. The Terms are part of every sales contract concluded through dglow.si.

4. Registration and user account

A purchase can be made as a guest (without registration) or with a user account. When creating an account, the customer provides a name, email address and password. The customer is responsible for protecting their username and password and for all activities that occur under their account.

The customer may request deletion of their user account at any time by sending a message to info@dglow.si. The seller reserves the right to temporarily or permanently close an account in the event of a breach of these Terms or misuse of the service.

5. Products and information

The products presented in the online store are cosmetic and skincare products. Each product is described with a name, price, composition (where relevant), description and photographs. Product images are illustrative - minor variations in colour, packaging or size are possible, particularly due to differences between screens.

Before using a cosmetic product, the customer should check the composition, instructions and manufacturer warnings stated on the packaging or in the product description.
dglow.si is not liable for allergic reactions or adverse effects arising from improper use of the product or the customer's individual sensitivity, except in the cases set out in section 7 (material defects).

6. Prices and VAT

All prices stated in the online store are in euros (EUR) and include value added tax (VAT) in accordance with applicable Slovenian law. Prices are final for the consumer and do not include delivery costs, which are shown at the checkout step before completing the order.

The seller reserves the right to change prices without prior notice. The price valid at the time the order is placed is final and does not change, even if the seller changed the product price in the store after the order was placed.

In the case of an obvious pricing error (e.g. a €50 product shown at €5), the seller reserves the right to reject the order and refund any purchase price paid. We notify the customer of the error within 24 hours.

7. Purchase process and conclusion of the contract

A purchase proceeds in the following steps:

1. The customer selects products and adds them to the cart.
2. In the cart, the customer can change the quantity or remove products.
3. At the checkout step, the customer enters contact details, delivery address, delivery method and payment method.
4. Before completing, the customer reviews the order summary with the total price (products + delivery + VAT).
5. By clicking the "Pay now" or "Place order" button, the customer submits a binding offer to conclude the contract.
6. After the order is received, the customer receives an automatic email confirmation. The contract is concluded when the seller confirms the order (no later than 1 business day) and processes the payment.

Before placing the order, all pre-contractual information is available to the customer in accordance with Article 130 of ZVPot-1: the main characteristics of the product, the identity of the seller, address, phone, email, the final price including VAT, delivery costs, payment method, delivery, performance, the right of withdrawal, out-of-court dispute resolution, and the warranty for material defects.

The contract is concluded in the Slovenian language and stored in electronic form. The customer may receive a copy at the email address provided with the order.

8. Payment methods

We accept the following payment methods:

• Credit and debit cards (Visa, Mastercard, American Express, Maestro) via the Shopify Payments / Stripe platform;
• Apple Pay and Google Pay;
• PayPal (once activated);
• Payment by proforma invoice via bank transfer - UPN (on express request, contact info@dglow.si).

All card payments are processed via a secure connection (PCI DSS Level 1, 3D Secure). dglow.si does not store card details - these are processed directly by the payment processor.

9. Delivery

Details on delivery times, costs and areas are described in a separate document, Shipping Policy. In short:

• Slovenia: standard delivery €3.90 (free over €70), 2-3 business days.
• EU: flat delivery price €12.00, 3-10 business days. We currently do not ship outside the EU (United Kingdom, Switzerland, Norway).

The risk of loss of or damage to the product passes to the customer at the moment the customer or a third party (other than the carrier) takes possession of the product (Article 133 of ZVPot-1).

10. Right to withdraw from the contract

The consumer has the right to withdraw from the sales contract within 14 days of receiving the product, without giving a reason (Article 134 of ZVPot-1). The procedure, exceptions (in particular for opened cosmetics) and the withdrawal form are described in a separate document, Refund Policy.

11. Material defects and warranty

The seller is liable for material defects of the product in accordance with Articles 80 to 87 of ZVPot-1 and the provisions of the Obligations Code.

A material defect exists when:

• the product does not have the properties necessary for its normal use or trade;
• the product does not have the properties necessary for the particular use for which the customer is buying it, and which was known to the seller;
• the product does not have the properties that were expressly or tacitly agreed or prescribed;
• the seller delivered a product that does not match the sample or model.

The customer may assert a material defect within 2 years of the day of receiving the product, by notifying the seller within 2 months of the day the defect was discovered. When asserting a claim, the customer has the right to request, at their own choice: free removal of the defect, replacement, a proportionate price reduction, or withdrawal from the contract with a refund.

Complaint procedure: report the defect at info@dglow.si, describe it, and attach photos and your order number. The seller covers the cost of returning the product being claimed.

12. Personal data protection and cookies

We regulate the processing of personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the Personal Data Protection Act (ZVOP-2). Details are described in the Privacy Policy.

We regulate the use of cookies and similar technologies in the Cookie Policy.

13. Intellectual property

All content of the dglow.si online store - texts, images, graphics, logos, videos, design - is the property of Lun Maligator d.o.o. or its licensors and is protected by the laws of the Republic of Slovenia and international intellectual property conventions.

The brand names and logos of the products sold in the store (e.g. COSRX, Anua, Beauty of Joseon) are the property of their manufacturers and are used solely for informational and descriptive purposes.

Without the seller's prior written permission, copying, reproducing, distributing or commercially using the content of the online store is prohibited. Personal, non-commercial viewing and printing for private use is permitted.

14. User reviews and comments

After a purchase, the customer may submit a product review. By submitting a review, the customer grants the seller a non-exclusive, royalty-free, unlimited-term right to use, publish, adapt and distribute the review within the online store and the marketing activities of dglow.si.

The seller reserves the right not to publish, to edit, or to remove a review that contains offensive language, false information, malicious content, third-party personal data, or breaches of these Terms.

15. Minor customers

The dglow.si online store is accessible to all age groups. In accordance with Slovenian law (the Obligations Code):

• Adults (18+) may conclude sales contracts without restrictions.
• Minors over 15 years of age may conclude contracts for products of everyday importance (Article 108 of OZ), which in the case of cosmetics generally applies to purchases below a certain value threshold.
• For larger purchases or contracts that exceed everyday use, minors need the consent of a legal representative.

By confirming a purchase, the customer confirms that they meet the conditions for concluding a contract in accordance with Slovenian law.

16. Limitation of liability

The seller strives to ensure the accuracy and timeliness of the information in the online store, but is not liable for any typographical errors, inaccuracies in product descriptions, or outdated stock information.

The seller is not liable for damage arising from:

• improper use of the product contrary to the enclosed instructions and warnings;
• individual sensitivity or an allergic reaction that the customer could not foresee and the seller could not detect;
• unavailability of the online store due to technical reasons or force majeure;
• the operation of third-party providers (Shopify, payment processors, couriers) over which the seller has no direct influence.

The limitation of liability does not apply in cases of the seller's intentional conduct or gross negligence, nor does it affect the mandatory consumer rights under ZVPot-1 and OZ (in particular regarding material defects and withdrawal from the contract).

17. Changes to the Terms

The seller may update the Terms from time to time. Changes take effect on the day they are published on the dglow.si website. For orders placed before a change, the Terms in force at the time the order was placed apply.

We will notify registered users by email of material changes that would significantly affect the customer's rights.

18. Applicable law and jurisdiction

These Terms and all sales contracts concluded through dglow.si are governed by Slovenian law, without regard to conflict-of-law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

For the resolution of any disputes between the seller and customers who are not consumers, the competent court in Celje (Slovenia) has jurisdiction. For consumers, their mandatory jurisdiction under ZVPot-1 applies - the court in the place of the consumer's permanent residence has jurisdiction.

19. Out-of-court dispute resolution

We seek to resolve disputes between dglow.si and the consumer amicably. If agreement is not possible, the consumer may:

• use the European Commission's online platform for out-of-court resolution of consumer disputes (ODR): https://ec.europa.eu/consumers/odr (contact email of dglow.si: info@dglow.si);
• contact the Market Inspectorate of the Republic of Slovenia (Dunajska cesta 160, 1000 Ljubljana, email: gp.tirs@gov.si) for supervision of compliance with ZVPot-1.

In accordance with the third paragraph of Article 32 of the Slovenian Out-of-Court Resolution of Consumer Disputes Act (ZIsRPS), dglow.si expressly does not recognise any provider of out-of-court consumer dispute resolution as competent.

20. Severability of individual provisions

If any provision of these Terms is invalid, unlawful or unenforceable, this does not affect the validity of the remaining provisions. The invalid provision is replaced by a provision that best corresponds to the original intent and complies with applicable law.

21. Prohibited use

When using the online store, it is prohibited to:

• use the service for unlawful purposes or to incite unlawful acts;
• infringe the intellectual property rights of the seller or third parties;
• harass, insult or discriminate against other users or employees;
• provide false or misleading information when ordering (in particular regarding identity or payment methods);
• upload malicious software (viruses, trojans) or otherwise attempt to compromise the security of the online store;
• use automated systems (bots, scrapers) to obtain content or place orders without the seller's express written permission.

In the event of a breach, the seller may permanently block access to the service and, in the case of damage, pursue claims for compensation.

22. Contact

We usually respond within 1-2 business days. For questions relating to legal or contractual matters, we respond within the statutory deadlines (1 month for personal data requests, 14 days for withdrawal from the contract, etc.).
